Non-citizens buy residential property through defined schemes rather than freely on the market: the IRS, RES and PDS schemes and Smart City projects, promoted through the Economic Development Board. Each carries its own conditions, and the documents deserve to be read before signature rather than after — on the extent of what is sold, on resale, and on what happens to the property on death.

Residence and permits

The Occupation Permit is handled through the Economic Development Board; the Residence Permit for retired non-citizens and the Premium Visa, administered by the Passport and Immigration Office, cover other routes; the permanent residence framework is in the Immigration Act 2022. We advise on the legal effect of these, not on the administrative process, which belongs to those authorities.

Successions with assets in France

Mauritius is a civil-law jurisdiction and succession here is governed by the Code Civil Mauricien. French clients usually find the framework familiar in structure — which is precisely why it is dangerous to assume it is identical to French law. Mauritius levies no inheritance, estate, succession or donation tax; your French position remains a matter for your notaire or French counsel. Family matters and mixed marriages

Where one spouse is French and the other Mauritian, or where a couple married in France and now lives here, the first questions are where the marriage was celebrated, under which matrimonial regime, and where the family is habitually resident.
